
Dallas CONSULAR PROCESSING Lawyers
For many immigrants coming to the U.S. from another country, the normal way to apply for and obtain U.S. lawful permanent residence (a "green card") is through a procedure called consular processing. This is also the path that many people who entered the United States unlawfully will have to take. Its key feature is that, after some communication with U.S. Citizenship and Immigration Services in the U.S. (USCIS), the immigrant will deal primarily with, and attend a visa interview at, a U.S. embassy or consulate, likely in his or her home country.
The Consular Processing Timeline
This process starts with filing the I-130 petition from your U.S. citizen family member. Unfortunately, this step can take up to a year for approval. Once approved, the case will be transferred to the National Visa Center (NVC).
At the NVC stage, the following steps occur:
- Pay the required visa fee.
- Submit all applications and supporting documents.
- File a provisional waiver, if necessary.
Depending on your case, this part of the process can take anywhere from six months to three years. We remain hopeful that these processing times will improve.
What Happens After NVC Approval?
Once the NVC has received all documents and any provisional waiver is approved, your case will be transferred to your embassy or consulate for an interview.

- 1-2 weeks for Mexico
- 3-4 weeks for most other countries
