Understanding the Updated Provisional Waiver Process
Under the old process, immediate relatives were unable to apply for a waiver until after an interview for an immigrant visa abroad and a Department of State consular officer had determined they were inadmissible to the U.S. The waiver could not be submitted until after the interview and people often waited months, or even years, for a decision. In the meantime, the relative was required to remain outside of the country and away from the family.
In 2013, the Obama Administration started a new system that allowed the immigrant to apply for the waiver before leaving the United States. This process has drastically shortened the time that U.S. citizens and residents are separated from family while waiting to obtain immigrant visas.
